Terms and Conditions

INTRODUCTION

This document explains the terms and conditions under which Guildford Borough Council (GBC) provides information on this site. By accessing GBC's consultation website, you are agreeing to the terms set out below. The purpose of this website is to manage GBC’s planning policy consultations effectively. This consultation website is operated by staff working for GBC. If you have any questions or comments please contact planningpolicy@guildford.gov.uk

REGISTRATION

The details provided by you on registration are important and should be correct and complete.

1.           DEFINITIONS

“Personal information” refers to the information about you including your email address and any other information you choose to give us when you register or later on in your profile.

“Public information” refers to that information which you have chosen to give in relation to the planning consultation which will be accessible to all users of the site. This includes your name.

“User” means any person who is registered on the site as a User and any person who uses the information from the site as part of the planning process.

“Redacted Information” means any information which GBC officers believe to be irrelevant to the planning consultation at issue.

“Relevant Policies” those policies such as Data Protection Policy and the Privacy Policy as amended from time to time and should be read before using this site.

 

2.         ACCESSING THE SITE

2.1       This site is made available free of charge.

2.2       GBC does not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. 

2.3       GBC may suspend, withdraw, discontinue or change all or any part of our site without notice.

2.4       GBC will not be liable to you if for any reason our site is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to the site.

2.5       You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and conditions, and that those persons you invite comply with them

2.6       Users under 16 should ask for permission from a parent or guardian before providing any personal information.

 

3.         YOUR PERSONAL INFORMATION

3.1       GBC will respect your personal information and will only use that information in accordance with the preferences set out by you on Registration and as amended by you from time to time under "My Profile".

3.2       Personal information held within the consultation system will not be passed to, or shared with any third party except for the purposes of the consultation process, a Planning Inspector may wish to see your personal information in order to invite you to an examination event.

3.3       This system (getinvolved) is hosted externally to GBC. GBC is the data controller and INOVEM Ltd. act as data processor. The personal data you submit are held on behalf of the Council by INOVEM Ltd., Weston Court, Newbury Road, Weston, Berkshire, RG20 8JE. Registered in England under Company Number 4228932.  Their data protection Notification Number is Z8289153. INOVEM support staff has access to the information in the system for system administration and monitoring purposes on behalf of the Council. 

3.4       Responses that you provide to individual consultations for GBC – including responses to surveys, discussion groups, or comments on individual documents - will be collected and processed appropriately and used internally to the extent that is needed to fulfil operational needs or to comply with any legal requirements. Any information public or private required by a court of law in relation to a legal process will be given to the appropriate body.

3.5       GBC ensures that only staff who have a business reason to look at your information or data can do so, in addition GBC undertake to comply with the Data Protection Act 1998 and GBC's Data Protection Policy. GBC do not allow advertisers or Users to send unsolicited commercial emails (SPAM). If you receive any such email, please inform us. Should you have any concern regarding collection, processing, storage or disclosure of information submitted via this consultation website please contact GBC Planning Policy at planningpolicy@guildford.gov.uk.

 

4.         YOUR ACCOUNT AND PASSWORD

4.1       You will be provided with, a user identification code and password as part of our security procedures; you must treat such information as confidential. You must not disclose it to any third party.

4.2       GBC have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms and conditions.

4.3       If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at planningpolicy@guildford.gov.uk. You must also take steps to change your password (this can be done through the ‘My Profile’ tab).

 

5.         USING THE WEBSITE FOR CONSULTATION

5.1       The consultation responses you provide as part of this consultation may be made available to agents who help with our research. Responses to planning consultations are usually made public. If you do not want all or part of your response to be made public, please state in the response which parts you wish us to keep confidential. Where confidentiality is not requested, responses may be made available to any enquirer, including enquirers outside the UK, or published by any means, including on the Internet.

 

6.         INFORMATION ACCURACY

6.1       GBC is committed to the highest standards of quality in the information provided on this site. While every care has been taken to ensure the accuracy of information on this consultation website GBC accepts no responsibility for any errors, omissions, or misleading statements on these pages. GBC is not liable for any action you may take as a result of relying on such information or advice or for any loss or damage suffered by you as a result of taking this action.

6.2       Although GBC make reasonable efforts to update the information on our site, GBC make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

 

7.         INTERACTIVE AREAS

7.1       The consultation website may include discussion groups/forums and other public areas that allow feedback to GBC and interaction between users. GBC does not control the information posted to these areas but it does expect contributors to comply with the following rules:

8.         REDACTION, MODERATION, EXCLUSION AND SEVERABILITY

8.1       GBC may delete, move, edit or remove any communications it deems unsuitable without giving a reason. You are solely responsible for the content of your communications and you agree to indemnify GBC for any loss that GBC may suffer as a result of your communications, GBC retains the right to prevent you accessing the interactive areas of the website if you contravene these terms.

8.2       Message content in addition to those listed above in Clause 7.2 that may be edited or removed includes (but is not limited to):

8.3       Content that does not apply to the topic of the consultation concerned may be referred to the relevant department in GBC but may not receive a response from the consultation team. GBC reserves the right to use only the information relevant to the consultation.

8.4       You should not use this site to make any formal requests for information from the Council.  Formal requests should be addressed to iro@guildford.gov.uk. If your message is identified as including a request for information, the request may be referred to the relevant department at GBC. However, we would request comments on this site be limited to the Planning Consultation.

 

9.         TRADEMARKS

9.1       All trademarks that may appear on the site are acknowledged, and are the property of their respective owners.

 

10.       COMPETITIONS

10.1     GBC may run competitions on this website to increase reader participation, when such a competition is run GBC will advise you via our website and advise you of any prizes, all information gained from such a competition will become the property of GBC and any results of such a competition shall be final.

 

11.       TERMINATION

11.1     A User will be deleted from the site if they breach any term of this contract or by providing more than one name to put forward more than one opinion, by hacking, by using it in a manner for which it is not intended and by the User providing false Information.

 

12.       CHANGES TO TERMS AND CONDITIONS

12.1     GBC reserves the right to change these terms and conditions at any time. GBC will notify you of any changes by placing a notice on our website. Please check this page from time to time to take notice of any changes GBC make, as they are binding upon all Users.

 

13.       VIRUSES

13.1     GBC does not guarantee that our site will be secure or free from bugs or viruses.

13.2     You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

13.3     You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. GBC will report any such breach to the relevant law enforcement authorities and GBC will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

 

14.       LIMITATION OF GBC LIABILITY

14.1     In the event that legal action is taken against GBC for information which you have provided and as a result of such information, you will provide us with an indemnity for the costs of any action and the resultant damages which may be ordered from the action.

 

15.       LINKS TO OTHER SITES

15.1     This consultation website contains links to other sites. Please be aware that GBC is not responsible for the privacy practices of other websites and does not accept any liability for action you may take as a result of relying on information or advice obtained from such sites. GBC encourage our Users to be aware when they leave our site and to read the privacy statements of other websites

 

16.       SEVERABILITY

16.1     If any provision of this agreement is found to be void or unenforceable, that provision shall be deemed to be deleted from this agreement and the remaining provisions of this agreement shall continue in full force and effect and the parties shall use their respective reasonable endeavours to procure that any such provision is replaced by a provision which is valid and enforceable, and which gives effect to the spirit and intent of this agreement.

 

17.       WAIVER

17.1     A waiver of any right or remedy under this agreement or by law is only effective if given in writing and shall not be deemed a waiver of any subsequent breach or default.

19        LAW AND JURISDICTION

19.1     If any dispute arises out the use of this consultation website you agree that these terms shall be governed by and interpreted in accordance with English law and be subject to the exclusive jurisdiction of the English courts.
